The Tamilnadu Electricity Board filed a petition before the Tamilnadu Electricity Regulatory Commission praying for hiking the price of electricity supplied to domestic segment of the consumers. In it's petition the Board informed that the cost of supply of Electricity was Rs.4.69 during the year 2009-10. The Board has further informed that the State Government has paid Rs.210 crores for the year 2009-10 towards the subsidy for agricultural consumption since the electricity is supplied to this segment at free of cost in accordance with the direction of the commission. Further the Board informed that the consumption of Agricultural segment during the year 2009-10 was 11918 million umits. Instead of directing the Government to pay the actual cost of supply at the rate of Rs.4.69 per unit the commission directed the Government to pay an amount of Rs.250 per hp of connected load per year which is much less to the actual cost of supply. The Electricity Regulatory commission has no powers to ignore the Electricity Act 2003. . According to section 61 the tariff fixed by the commission should refelect the cost of supply of electricity and should eliminate cross subsidy. But the Tamilnadu Electricity commission ignoring the law directred the Government to pay an amount much less than the cost of supply.
